Terms of Use

4.1. Registration

To access the functionality of the Website or Software, you need to create an account by following the provided instructions.

By creating an account, you confirm that you meet the criteria of an Eligible User. IF YOU DO NOT MEET ANY OR NONE OF THESE CRITERIA, IMMEDIATELY STOP USING THE WEBSITE.

A User may have only one account.

4.2. Accuracy of Information

During registration, you are required to provide accurate, current, and complete information about yourself. You are responsible for maintaining the accuracy of this information.

4.3. Account Security

You are responsible for maintaining the confidentiality of your password and restricting access to your account. You agree to promptly notify us of any unauthorized use of your account.

4.4. Right to Delete

You have the right to delete your account along with all User Content created in it at any time. This can be done directly in the app through profile settings or, if needed, by contacting us at support@enhance-your-ability.com.

4.5. Deletion Consequences

After deleting your account, your data and User Content will be removed from our active systems. However, some backup copies or residual data may be retained for a certain period in accordance with our Privacy Policy.

5.1. License

We grant you a limited, non-exclusive, non-transferable license to access and use the Website for personal non-commercial purposes in accordance with these Terms ("License").

5.2. Prohibited Use

Unless otherwise provided in these Terms, the User is prohibited from:

1. Modifying, adapting, decompiling, reverse engineering, or otherwise attempting to obtain the source code of the Software;
2. Transferring, selling, sublicensing, or providing access to the Software to third parties;
3. Allowing third parties to use, copy, or modify the Software in any way;
4. Patenting the Software or any of its parts;
5. Using the Software for purposes other than those specified in these Terms;
6. Copying or reproducing the Software in any way;
7. Using the Software to create or distribute content containing illegal, defamatory, violent, or discriminatory materials;
8. Using the Software for illegal, fraudulent, or harmful purposes; and
9. Uploading or distributing illegal content, including pornographic, violent or discriminatory materials, malware, phishing, and any content related to illegal activities (weapons, drugs, illegal gambling, etc.).

5.3. Ownership

All intellectual property rights to the Software and Website belong to EYA. No provisions of these Terms grant the User any licenses or rights other than those expressly defined in these Terms. All rights not expressly granted to the User remain with EYA.

5.4. License Term

The License is valid for an unlimited period.

The License may be immediately revoked and the User's account deleted:

1. as a result of the User's violation of these Terms; or
2. as a result of the User deleting their account.

5.5. Updates

EYA may periodically release updates to the Software that include:

1. performance improvements,
2. bug fixes,
3. addition of new features,
4. modification or removal of certain features.

6.1. Subscription Types

1. Free — basic functionality for personal use.
2. Pro (9 EUR / month) — advanced features, including premium voices for more natural sound.
3. Business (29 EUR / month) — for professional and organizational use, includes:
   • • creating workspaces (Workspaces);
   • • team and client management and their content;
   • • collaborative resource creation (cards, voices, materials).

   The cost of the Business subscription is calculated based on a base fee of 29 EUR per month plus 5 EUR per active workspace user.

   Payment is made by the organization or center that owns the respective workspace and covers all connected users.

6.2. Payment

Payment is made in advance for the selected period (monthly or annually). Payments are processed through secure services (LiqPay). EYA does not store Users' payment data.

6.3. Automatic Renewal

The subscription renews automatically unless canceled before the end of the current period.

6.4. Subscription Cancellation

Users can cancel their subscription in profile settings or by contacting support. Access is maintained until the end of the already paid period.

6.5. Refunds

Refunds are not provided for unused or partially used subscription periods, except as expressly provided by law. In case of significant service failures on our part, we may provide compensation in the form of subscription extension.

6.6. Price Changes

EYA may change subscription prices. New rates take effect from the next billing period after notifying users.

6.7. Suspension Due to Non-Payment

In case of non-payment, EYA has the right to suspend or terminate the subscription.

7.1. Ownership Rights

All materials available through the Website, including but not limited to texts, images, videos, card sets, logos, and Software, are the property of EYA or our licensors and are protected by copyright laws and other intellectual property laws.

7.2. Content Usage

You may view, download, and print materials from the Website for personal non-commercial use, provided that all copyright notices and other proprietary rights are maintained. Any other use of materials without our prior written consent is prohibited.

8.1. Content Provision

By submitting, uploading to the Website, or publishing on the Website User Content, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such User Content in accordance with the terms set out in these Terms and the Privacy Policy.

8.2. Feedback

By submitting or publishing feedback on the operation of the Website and Software, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such feedback for the purpose of improving our Website and Software.

8.3. Warranties

You represent and warrant that you own all rights to the User Content you provide and that such User Content does not infringe the rights of third parties.

9.1. Data Collection

By using and interacting with our Website (including texts, messages, and other User Content that you leave during interaction), you agree that we may collect and use this data to train and improve our artificial intelligence models.

9.2. Privacy

We are committed to processing your data in accordance with our Privacy Policy, ensuring their protection and confidentiality.

10.1. Usage

Our Website and Software are provided "as is" and "as available". We make no warranties regarding the accuracy, completeness, or availability of our Website and Software, or their suitability for your expectations.

10.2. Disclaimer of Liability

To the extent permitted by law, we are not liable for any direct, indirect, incidental, special, or consequential damages arising in connection with the use or inability to use our Website and Software.

11.1. Law

These Terms and the provision of Services are governed by the laws of Ukraine.

11.2. Dispute Resolution

Disputes are resolved through negotiation or in court at the location of EYA.
